Antitrust spotlight and inspections – in tandem with the special unit of the Gdf – on the activity of the Post Office which uses the offices and the postal network – its exclusive availability as provider of the universal postal service – also to sell the offers of Poste Energia. Instead, it should also make them accessible to the subsidiary’s competitors PostePay.
This is what the Antitrust Authority wants to clarify, having started an investigative procedure against Poste Italiane, precisely to ascertain the existence of violations of article 8, paragraph 2-quater, of the law for the protection of competition and the market which refers to public companies and their subsidiaries.
The Agcm’s activity starts from some reports, according to which “Poste Italiane has not made these goods or services accessible to some of its competitors”. PostePay who have recently requested it. In this way it attributed to its subsidiary a significant competitive advantage, capable of irremediably altering the competitive dynamics in a unique market context – characterized by the end of protected regimes in the supply of electricity and natural gas – in which active operators have strong incentives to attract customers from protected regimes”.
The Antitrust, in addition to opening the file, has also initiated proceedings to adopt any precautionary measures “to restore the level playing field in the markets in question, which would have been distorted by the conduct under investigation”.
