It concerns everyone, whether they use a credit card or not… Decision from KDK for money points!

According to the decision of the Ombudsman Institution (KDK), the person working in a health institution in Zonguldak was not paid points, which were part of the salary promotion, citing his disability in using his credit card.

The person, whose attempts to pay the points were unsuccessful, applied to KDK.

KDK, which examined the application, found that although it was possible to load the money point amounts to people’s bank cards, the payment was not made to the relevant people by the bank without a legal justification. KDK recommended that beneficiaries should be paid for points via debit card.

The decision pointed out that the cash points were a part of the promotion fee and emphasized that this should be evaluated within the scope of the “right of property” guaranteed in the Constitution.

The following was noted in the decision:

“When the applicant’s claims, the administration’s statements, the relevant legislative provisions and the information and documents within the scope of the entire file are evaluated together, the process of not loading the money points amount to the applicant’s credit card, which is a part of the promotion amount to the applicant, which should be loaded in January 2023, and who already has a credit card, is against law, equity and justice. “It has been concluded and concluded that it is not in compliance with the principle of equality.”
