New decision for agricultural lands that have not been transferred: Inheritance certificate will be requested


The Regulation on Amendments to the Farmer Registration System Regulation prepared by the Ministry of Agriculture and Forestry came into force after being published in the Official Gazette.

The Regulation determines the procedures and principles regarding the use of ÇKS, which was established to record the agricultural activities of farmers.

With the amendment, the principles regarding farmers’ registration to ÇKS, carrying out checks and updating the system were regulated.

Accordingly, the lands subject to the contract will be checked on-site by satellite images of the production year or by detection commissions.

If the heirs or shareholders object to the lands subject to the commitment within the production year, the records of these lands will be terminated for the areas corresponding to the objected shares, starting from the current production year until the end of the commitment period.

If there is an objection by the shareholders or heirs to the lands that are part of the inheritance and applied for with a letter of undertaking, the records of these lands will be terminated for the areas where the shares subject to the inheritance are objected, starting from the current production year until the end of the commitment period.

In the event of the death of the owner registered in the land registry, the lands for which the right of inheritance has not been registered in the name of the heirs specified in the inheritance certificate obtained from the court or notary will be considered within the scope of the lands that have not been transferred.

If the heirs object to the applications made by letter of undertaking for lands that have not been transferred, a certificate of inheritance will be requested.

If there is no share of one’s own on the land for which the application is made, a lease agreement or undertaking signed with the shareholders will be required. If this land is inherited and the share rates are not clear, a lease agreement or letter of undertaking signed with all shareholders will be required.

ÇKS records regarding the lands subject to the commitment will be suspended in the provincial and district directorates and headmen’s offices for 15 days in March of the production year. Any objections made later, except by shareholders or heirs, will not be taken into consideration.
