“Ilyashev and Partners” achieved the introduction of anti-dumping duties of 32.6% on wire importers from China

The law firm “Ilyashev and Partners” achieved the application of anti-dumping measures on the import of wires from the People’s Republic of China into Ukraine. This is reported by the press service of the law firm “Ilyashev and Partners“.

The decision to introduce final anti-dumping duties was made by the Interagency Commission on International Trade (ICIT) based on the results anti-dumping investigationinitiated by “Ilyashev and Partners” in 2021.

The complaint on behalf of the national producer – one of the largest Ukrainian producers of welding materials and semi-finished products for the production of welding electrodes, LLC “PlasmaTech” – was prepared by the international trade practice team under the leadership of partner Olena Omelchenko.

According to the results of the investigation initiated by Ilyashev and Partners, which lasted almost a year, the MKMT established the facts of causing significant damage to the national producer as a result of price dumping by importers from China.

During this time, the financial and economic indicators of the Ukrainian producer significantly worsened: production volumes decreased by a third, the level of production capacity utilization decreased by almost half, the volume of goods sold on the domestic market decreased by 46.07%, and, accordingly, the share of the national producer of domestic market.

The cost price of Ukrainian goods also increased, the national producer suffered significant losses.

On July 13, 2023, the MKMT adopted decision No. AD-549/2023/441-01 on the application of an anti-dumping duty for 5 years in the amount of 32.6% on the import into Ukraine of goods from China with the following description: silicon-manganese steel wire, which is classified according to the UCT of the ZED under the code 7229 20 00 00.

The decision of the ICMT entered into force on August 2, 2023 – the day of publication of the notice on the application of final anti-dumping measures on the import of wires from the People’s Republic of China into Ukraine.

The solution will help all national producers, among which are the largest enterprises of Ukraine, such as one of the largest enterprises for the production of metal products for industry and construction PJSC “Dniprometiz”, the largest producer of steel ropes in Ukraine PJSC “Production Association “Stalkanat-Silur” and others .

In addition, these measures will help enterprises that manufacture and sell raw materials for the production of wires, such as the largest enterprise of the mining and metallurgical complex of Ukraine, ArcelorMittal Kryvyi Rih PJSC.

“We were very much looking forward to this decision and are grateful to the Commission for restoring justice in the market. The import of wires from China increased by 40% after the beginning of the full-scale aggression of the Russian Federation against Ukraine, they tried to completely remove the national producer from the market.

All this time, national manufacturers have been working at great losses, covering the production of wires with other products in order to at least somehow maintain their presence on the market, – emphasizes Olena Omelchenko. – Now domestic enterprises will be able to increase production volumes, invest funds in the development of production capacities and increase labor productivity.”

We would like to remind that the Interdepartmental Commission for International Trade of Ukraine introduced the final anti-dumping duties on imports from China of a range of bolts and nuts in the amount from 32.47% to 67.4% depending on the manufacturer for a period of five years.

In this anti-dumping investigation, the law firm “Ilyashev and Partners” represented the interests of the Druzhkiv plant of metal products, which accounts for more than 50% of all domestic production of these products.
