Safety at work, here is the points-based license with bonuses and malus: starting from 30 credits

Illicit administration

The provision of the Jobs Act which in 2015 had replaced the crime with a fine of 20 euros per day for each worker employed illegally is abolished. Now this case, the antechamber of gangmastering, becomes a crime again.

Points licence

It starts next October 1st. It applies to businesses and self-employed workers who “work on temporary or mobile construction sites”. It’s about a “digital driving license” issued by the National Labor Inspectorate, if the following requirements exist:

• registration at the Chamber of Commerce
• fulfillment of training obligations by the company and workers
• possession of a valid Durc (Single contribution regularity document).
• possession of the DVR (Single Tax Regularity Document)

The license is initially issued with 30 credits and allows businesses and self-employed workers to operate on construction sites with an allocation “equal to or greater than 15”.

It suffers reductions depending on the violations regarding safety and work: from 5 credits for minor ones to 20 credits for death at work. Permanent, absolute or partial disability, for example, counts -15 and in this case the Inspectorate can suspend the license for up to 12 months.

The deducted credits can be reinstated following the “course attendance”. Each course allows you to recover 5 credits. The repurchased credits cannot exceed 15. Another 10 credits can be activated automatically two years after the sanction, one per year up to a maximum of 10.

An endowment less than 15 credits does not allow companies to operate on construction sites, without prejudice to the completion of activities “subject to contracts and subcontracts in progress at the time of the last reduction”.

Companies that continue to work even with a license that has less than 15 credits are punishable with a fine of 6,000 to 12,000 euros.

The information on the license flows into a national portal of the undeclared economy.

Strengthening of the inspectorate

There will be a new competition, for the years 2024-2026, to hire 250 technical inspectors on a permanent basis. Even on a regional basis. Allocated: 325 thousand euros in 2024, 2.5 million in 2025 and 1.5 million from 2026.
