The Kaluga distillery “Crystal” filed a lawsuit with the Intellectual Rights Court with a request to early terminate the legal protection of the Gatsby trademark for its use. Now the Gatsby brand is assigned to the German director Konstantin von zur Mühlen.
The lawsuit was filed on February 20, please note “Vedomosti”. It removes protection for the Gatsby mark from Class 33 of the International Classification of Goods and Services. This includes alcoholic beverages, including whiskey, brandy and bourbon. The defendant in the case is Konstantin von zur Mühlen.
The German director registered a trademark in 2018 in more than a dozen countries, including Russia. At the same time, according to Rosalkotabakkontrol, there is no alcohol under the Gatsby brand on the Russian market.
Vedomosti’s interlocutors say that this trademark refers to the hero of Francis Scott Fitzgerald’s novel The Great Gatsby and the film of the same name. The publication notes that Crystal previously used the names of films in its products – “Fantômas”, “Gladiator”. In 2023, the company tried to sue Disney for the Pirates of the Caribbean trademark, but the court rejected it.
