Auction period begins for properties with no liens in custody

Within the scope of the Enforcement and Bankruptcy Law, the principles regarding the liquidation of the seized properties under the custody of the trustee have been determined.

According to the notification on the procedures and principles regarding the implementation of the provisional article 20 of the Enforcement and Bankruptcy Law published in today’s issue of the Official Gazette, the liquidation of the assets within this scope will be carried out ex officio by the enforcement office where the proceedings are carried out.
Information regarding the goods decided to be liquidated by the enforcement office will be announced by the liquidation office through portals integrated into the UYAP Information System. The relevant customs administration will receive the liquidated goods that are not in free circulation within 10 days to carry out customs procedures.
‘Trustee’, a legal term, means the person to whom a property whose legal status is in dispute between more than one person is entrusted until the dispute is resolved.

If the liquidation process does not take place in this way, the relevant collection office will receive the liquidated property, which has a lien on it in accordance with the public receivables law, within 10 days for preservation or sale transactions.
If the liquidation process does not take place in this way, the goods will be delivered to the debtor and, at a later stage, to the lien holder.
If no liquidation results are obtained from these stages, the ex officio sales process will begin for the goods in question. The sale of goods will be made through electronic auction, and sales announcements will be made only on the electronic sales portal.
If the liquidation process cannot be accomplished through sale, the trustee may apply for the transfer of ownership of the goods. In the following stages, it may be decided to sell the goods as scrap to Makine ve Kimya Endüstrisi AŞ or transfer them to the Red Crescent free of charge.
