While a lawyer living in Manisa’s Alaşehir district won his legal battle against the TESLA company, he also gave hope to consumers in the same situation. Although it was written in the company contract that the pre-order price paid in the first application would not be refunded in accordance with the contract, Lawyer Mehmet Salcıoğlu from Alaşehir gave up the order and asked for the refund of the pre-order fee he paid due to the fact that the current vehicle price increased so much that it almost doubled from the price at the time of the first application. Salcıoğlu, who applied to the Consumer Arbitration Committee after TESLA company did not refund him, was found right and received back the 10 thousand TL he invested after the enforcement proceedings from the company.

The Consumer Arbitration Panel concluded that the consumer demand for the refund of the price in dispute was justified, as the economic conditions in the concrete dispute were excessively severe, there was an exorbitant difference between the vehicle price on the order date and the price offered later due to foreign currency, and since it was understood that the refund of the price received was required in the precedent Supreme Court decisions. decided in favor of the consumer.

Explaining his experiences, Lawyer Mehmet Salcıoğlu said, “In 2023, we ordered an electric car from TESLA on my wife’s behalf. While placing this order, we paid a pre-order fee of 10 thousand TL. Later, we gave up this order because the price of the vehicle increased too much due to the current economic conditions. However, this 10 thousand TL fee was not refunded to us by the relevant company. As a result, we applied to the consumer arbitration committee. The consumer arbitration committee decided that not refunding this 10 thousand TL fee would constitute an unfair condition, so it should be refunded to the consumer. “The decision given is in favor of the consumer. After the enforcement proceedings, we received a refund of the amount we invested of 10 thousand liras. The decision made by the consumer arbitration committee in this direction is a protective and inclusive decision for consumers who could not receive the relevant fee.” said.
