The number of people who can retire immediately under the retirement age law has been announced as 2.2 million. According to Habertürk, SGK completed the retirement process of 302 thousand 102 SSK members, 40 thousand 443 Bağ-Kur members and 27 thousand 514 Retirement Fund participants throughout the year 2022, and also awarded disability pensions to approximately 11 thousand people. While 381 thousand people were given a pension in the whole last year, 1 million of the 1.8 million EYT members who applied for retirement were paid within 2 months. It is expected that the monthly bonding process of the remaining 800 thousand people will be completed in a short time.

THE RISK OF CONNECTING INCORRECT MONTHLY INCREASED FURTHER

Retirement pensions are carried out by expert personnel at SGK. In order to speed up the processes of EYT members, non-expert personnel were also given accelerated training and assigned to the job of tying pensions. In the process of connecting pensions, errors can occur in normal times for various reasons. Due to the acceleration of the process, the risk of erroneous pensions to EYT members increased even more.

WHAT HAPPENS IF AMOUNT IS WRONGLY CALCULATED?

The monthly amount can be calculated incorrectly due to reasons such as the detection of some services later, the confusion of services belonging to other people, the incorrect entry of the day and earnings information or other information into the monthly setting programs. If this situation is determined later, the pension is recalculated and corrected as of the date of the retirement petition.

If the new calculated pension is higher than the old one, the differences calculated from the start date are paid to the pensioner.

If the new monthly calculated is lower than the old one, first of all, it is checked whether the error is caused by the citizen or SGK. In the event that the overpayment is caused by the willful or faulty behavior of the citizen, the overpaid amounts are refunded for a period of 10 years. If the overpayment is due to the faulty transactions of the SSI, the overpayments made in the 5-year period backwards are collected.

The citizen’s fault for overpayment is usually due to fake insurance. The pensions of people who are found to be insured from a workplace even though they are not actually working are deemed invalid, so their pension can be reduced or cancelled.

There is no loss of rights for those whose pension is paid incorrectly due to the fault of SSI. The erroneous transaction is corrected and the monthly difference calculated from the date of the retirement petition is paid to the pensioner.

EYT members, whose pension is paid incorrectly, can apply to the social security provincial directorates with a petition. Especially, those who have a difference between the amount they see in the salary robot in the e-Government before applying for retirement and the pension they receive can request a recalculation of their pensions.

A APPLICATION MUST BE GIVEN

The Social Security Institution informs citizens who receive a pension in detail. A petition should be submitted to take into account the missing services (premium days), if any, by checking the service records.

In accordance with the law enacted this year, the pension of those whose pension is below 7,500 TL is completed by the Treasury to 7,500 TL. While pensions are increased every 6 months in January and July, primarily root pensions are increased. If the root pension calculated for the inflation difference is below the current limit of 7,500 TL, the difference is covered by the Treasury, and 7,500 TL is paid to the pensioner.

For example, let’s take the case of a person whose root pension is 6,100 TL but who is paid 7,500 TL. If the inflation is 30 percent in the January-June period this year, this pensioner will receive a monthly salary of 7,930 TL instead of 7,500 TL as of July, as this pensioner’s root pension from 6,100 TL will increase by 30 percent to 7,930 TL. If this person’s root pension is mistakenly calculated as 5,000 TL instead of 6,100 TL, the 30 percent inflation difference will be calculated for 5,000 TL this time. Since the calculated amount will be 6,500 TL, this pensioner will continue to receive 7,500 TL monthly after July.

The person with the EYT in question should not think, “Whether my root pension is 6.100 TL or 5,000 TL, it doesn’t matter, 7.500 TL is paid anyway,” and should make an objection. Because, although the lowest pension was increased from 3,500 TL to 5,500 TL and then to 7,500 TL, in the last year, it may not always be increased in this way. For this reason, EYT members who receive pensions below the lowest pension should not neglect to submit a petition if there is an error in their pensions.
