One of the landlord-tenant disputes brought to the judicial authorities in Istanbul turned into a “slander” case due to the allegation that a forged signature was used in the eviction notice and this claim was not found to be true.

According to the information reflected in the indictment prepared by the Istanbul Chief Public Prosecutor’s Office, the tenant Basri A filed a complaint against the landlord Kemal G to the prosecutor’s office, claiming that he filed an eviction lawsuit against him with a fake undertaking by forging his signature.

Following the complaint, an investigation was launched against Kemal G. for “forgery of private documents”.

SIGNATURE BELONGS TO THE TENANT

The prosecutor’s office sent the eviction letter to an expert to compare the signatures of the tenant and the landlord.

During the examination, it was determined that the signature belonged to the tenant Basri A, who notified the prosecutor’s office.

Thereupon, the prosecutor’s office decided not to prosecute the landlord, but filed a lawsuit against the tenant, Basri A., for “slander”, demanding imprisonment from 1 to 4 years.

Defendant Basri A, who made his defense in the case heard at Istanbul Criminal Court of First Instance, said that he was disturbed by his landlord because he could not pay the rent and enforcement proceedings were initiated against him, and then the landlord filed an eviction lawsuit in the civil court, citing an eviction undertaking.

Claiming that he did not sign a commitment, and that one of the documents he signed with the real estate agent while renting the house 3 years ago could be a letter of commitment, the defendant requested acquittal, arguing that he could prove that the signature on the document did not belong to him and that he was somewhere else at the time the document was drawn up.

THE COURT PUT THE LAWYER’S COST ONTO THE TENANT

The court that decided the case sentenced the defendant to 10 months in prison for “slander” for causing an unfair investigation against the landlord.

The court, which postponed the sentence and ordered the defendant to be subject to a 1-year supervision period, also decided that the defendant should pay 17 thousand 900 lira attorney fee to the landlord’s lawyer.
