According to the Law on Amendments to the Code of Criminal Procedure and Certain Laws, publicly known as the “8th Judicial Package”, the amount of retirement holiday bonus was increased from 2 thousand lira to 3 thousand lira.
In order to fight crime more effectively and provide deterrence, the lower amount of a one-day judicial fine is being increased from 20 lira to 100 lira, and the upper amount is being increased from 100 lira to 500 lira. This regulation will come into force on June 1, 2024.
With the amendment made to the Turkish Penal Code, taking into account the reasons for annulment of the Constitutional Court, the act of committing a crime on behalf of an organization without being a member of it is regulated as a separate crime. Accordingly, a person who is not a member of the organization but commits a crime on behalf of the organization will also be sentenced to imprisonment from 2 years and 6 months to 6 years. Depending on the nature of the crime committed, the penalty may be reduced by up to half. This provision will only apply to armed organizations.
In terms of crimes committed against state security and constitutional order, a person who is not a member of an armed organization but commits a crime on behalf of the organization will also be sentenced to imprisonment from 5 to 10 years.
In individual applications made to the Constitutional Court in cases where investigations and prosecutions within the scope of criminal law and trials within the scope of private law and administrative law are not concluded within a reasonable time, those who have been given a decision of inadmissibility on the grounds that the Constitutional Court’s remedies have not been exhausted, and those who have been given a decision to dismiss on the grounds that there is no reason justifying the continuation of the investigation, must apply within the specified period. The file is allowed to be examined by the Compensation Commission.
