Díaz prepares the law with which he wants to reduce the representativeness of Cepyme in social dialogue

The Ministry of Labor of Yolanda Díaz plans to approve a law this year to redesign the configuration of the social dialogue table and achieve greater representation of small and medium-sized companies and act as a counterweight to the CEOE and Cepyme, the majority employer of SMEs.

This is the Law regulating business representativeness in the field of small and medium-sized companies, included in the Government’s Annual Regulatory Plan, Europa Press reports.

The main objective of the law will be to “develop the rules of business representativeness”, especially those related to the greater representativeness of small and medium-sized companies in the field of social dialogue, collective bargaining and institutional participation.

This movement occurs after the Government, through the Minister of Agriculture Luis Planas, open the door to giving greater representation to Unión de Uniones in exchange for its support.

In the matter of SMEs, it arises from the background Conpymes. Since its launch it has had true harmony with the Minister of Labor herself and with Begoña Gómez, wife of the President of the Government. The president of this association, José María Torres, defends that his organization has the basic criterion of representativeness: defending 10% of the working population, especially in Catalonia and the Balearic Islands. However, Conpymes is not part of SME United, the business ‘lobby’ of European SMEs where Cepyme does appear. Among its partners are COAG, Fenadismer and the Catalan Pimec.

Include unions in the Councils

The regulatory plan also includes another initiative for unions to be present on the boards of directors of companies and business groups. The leader of Sumar wants to promote more effective participation of workers within their respective companies, according to article 129 of the Constitution.

To do this, the German co-determination law would be emulated, with the aim of union organizations participating in the decisions of senior business leaders.

Regarding other laws, Díaz’s department raises a rule to modify the Workers’ Statute regarding dismissalto comply with the European Social Charter, reinforce causality in cases of job termination and eliminate automatic dismissal with sudden disability.

Among other projects, the regulatory plan includes in labor matters a comprehensive law to promote the social economy, another to regulate the national youth guarantee system in coordination with the Department of Youth and Children, the status of the scholarship holder and the reform of the subsidy for unemployment, which was attempted to be approved via decree but Podemos overturned it because it considered that it included a cut in the contributions of people over 52 years of age.
