Property administrators and real estate managers join the rejection of the vacation home law

CAF considers it important to “defend the right” of each owner to decide about their home, to choose and develop one activity or another, as well as the power of any owner who does not want the activity to be carried out in their community, as long as it is applicable legal regulations. At the same time, they emphasize that they have always been in favor of defending the interests of all the parties involved, speaking out in favor of regulating vacation rentals and establishing their conditions, just as the communities do, but not their prohibition since “users cannot be limited to choosing what type of accommodation they want to consume and that it does not have to be a hotel, apart from not “solving the rental problem on the islands.”

Acegi is in this same line, which also recognizes the importance of modifying the regulation that is intended to be applied, understanding that it is not the solution “to the serious housing crisis” that plagues the archipelago. From the point of view of its president, Rafael Tarajano, this measure alone will not be enough to solve “the underlying problems” faced by a region, in which “The different public administrations have failed to generate public housing in the last decades”.

In the case of CAF, they consider that this draft has “sounds of unconstitutionality”, violating municipal and exclusive powers of the State.

Contributions to the law

Likewise, Tarajano requests a balanced approach that addresses both the regulation of holiday housing and the promotion of public and private housing in “sufficient quantity”, thus guaranteeing a comprehensive solution to the housing crisis in the Canary Islands. In the same way, he pointed out that taking into account the current market demands it is “almost impossible to obtain energy ratings of B and C for apartments that are part of a community, understanding that this is a measure that”It can only be understood as an excuse to excessively limit the number of holiday homes“by the Government, “more than to save the planet.”

Another point that they ask to modify is the need to obtain express permission from the community of neighbors “goes against” the Horizontal Property Law, which already contemplates mechanisms to regulate this issue.

For its part, the CAF criticizes having been invited to the recent meeting of the Ministry of Tourism to inform the affected groups of the regulations, considering at the same time that far from solving the situation of people who aspire to residential rental, it will “cause the next used brick crisis”, because the owner will want to sell given the conditions that they want to impose.

Among the administrators they do not like that the hotel sector has become a defender of citizens as tenants, with the excuse of the lack of housing, stating that “if they are so concerned about the user of the holiday home and the tenant, they should support the ecotax or provide their own accommodation resources for their staff”, something that was done in the past and that they changed for more hotel beds.
