The Supreme Court (TS) has endorsed in a ruling that companies require security personnel who work facing the public in air-conditioned shopping centers to wear ties in summer.
The Social Chamber of the TS declares that this requirement does not violate the dignity of workers and considers that it is appropriate to the working conditions, since it only affects the security guards who provide service to the public in the premises of the shopping center. that has air, not applying to those who work during the summer in other positions such as warehouses, docks or surveillance outside the opening hours of the centers.
In its resolution, reported by Europa Press, the Supreme Court rejects the appeal of the Alternative Union of Private Security Workers union against the ruling of the National Court that ruled in favor of Sicor Seguridad El Corte Inglés.
The magistrates point out that the requirement to wear a tie respects both the agreement reached with other unions in the company and established in the Order of the Ministry of the Interior 318/11.
This order, specifically, leaves in the hands of the company the power to decide on the uniform of the security guards, taking into account its suitability to the working conditions, the season of the year and other possible circumstances of a functional, work or nature nature. personnel, as well as the dignity of workers and equality based on sex.
