Airbnb ordered to pay 1.3 million euros to the island of Oléron

Airbnb was sentenced on Tuesday to more than 1.3 million euros in civil fines as part of a new procedure initiated by the community of communes of the island of Oléron (Charente-Maritime) for breaches relating to the tourist tax.

The decision rendered by the La Rochelle court relates to the year 2022, after a previous conviction in mid-June 2023 for the 2021 financial year, which the community appealed with a view to obtaining a “more substantial” fine than the 30,000 euros pronounced at the time.

Non-compliance with obligations

Airbnb requested, in this respect, a stay of proceedings which was refused by the summary judge, seized by the community of municipalities of the island as part of an accelerated procedure on the merits.

“The company Airbnb, a major player in the hotel rental market by individuals in France, with a turnover of $8.4 billion in 2022, has not respected its obligations to collect the tourist tax, which which justifies, taking into account the repetition of the breaches, the imposition of a civil fine set at 10 times the amount of the tourist tax concerned, i.e. the sum of 1,360,000 euros,” indicates the court in its judgment.

The amounts to be paid sanction “failures to collect” the tourist tax for the year 2022, “omissions and inaccuracies” noted in the related declaration, and finally a “failure to fulfill the obligation to remit” this tax; they also cover procedural costs. This conviction, “historic” according to the community, is accompanied by a provisional execution measure.
